These Terms of Service ("Terms") govern your use of BulkPdfLabels's PDF label generation service. By using our service, you agree to these terms.

1. Agreement and Acceptance

By accessing or using BulkPdfLabels's service (the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not use our Service.

Legal Capacity: You must be at least 18 years old or have parental consent to use this Service. By using the Service, you represent that you meet these requirements.

Business Use: If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Service Description

BulkPdfLabels provides a web-based platform for generating custom PDF labels. Our Service allows users to create, customize, and download PDF label files for personal and commercial use.

Availability: We strive to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance and unexpected downtime may occur.

3. User Accounts and Registration

To access certain features, you may need to create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Promptly notifying us of any unauthorized use

Guest Accounts: You may use the label builder without registering. Guest sessions are temporary: they are limited to 100 generated labels and a maximum of 100 rows per batch, and the templates and data created in them are not saved permanently. Guest sessions expire 7 days after they are created, after which the account and any templates or generated files associated with it are permanently deleted. To keep your work, raise your limit to the free tier's 1,000 labels, and access the API, you must register an account. Registering converts your guest session and preserves the work associated with it.

One Account Per Person: Each individual is permitted one free account. Creating multiple accounts to circumvent usage limits, obtain additional free allowances, or otherwise abuse the Service is strictly prohibited. We employ technical measures including device fingerprinting and usage tracking to detect and prevent multi-account abuse. Accounts found to be in violation may be suspended or terminated without notice, and accumulated usage across all associated accounts may be aggregated for limit enforcement.

Account Re-creation: Deleting your account and creating a new one to reset free tier usage limits is a violation of these Terms. Usage history may be retained in anonymized form for abuse prevention purposes even after account deletion.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Acceptable Use Policy

You agree to use our Service only for lawful purposes. You may not:

• Create labels containing illegal, defamatory, or harmful content
• Infringe on intellectual property rights of others
• Upload malicious code or attempt to harm our systems
• Use automated tools to scrape or access our Service
• Create labels for fraudulent or deceptive purposes
• Violate any applicable laws or regulations
• Interfere with other users' access to the Service
• Attempt to reverse engineer or copy our Service
• Create multiple accounts to circumvent usage limits or obtain additional free allowances
• Use disposable or temporary email addresses to create accounts
• Delete and re-create accounts to reset free tier usage limits

5. Abuse and Prohibited Content

Content Restrictions: Users are prohibited from creating labels that contain:

• Hate speech, harassment, or threatening language
• Copyrighted material without proper authorization
• False or misleading information intended to deceive
• Content that violates privacy rights of individuals
• Material that promotes illegal activities

Enforcement: We reserve the right to review content and suspend accounts that violate these policies. Repeated violations may result in permanent account termination.

Reporting: Users can report abusive content or behavior through our contact channels. We investigate all reports promptly.

6. Payment Terms

Subscription Plans: We offer both free and paid subscription tiers with different feature sets and usage limits.

Free Tier: Registered free accounts include a one-time allowance of 1,000 generated labels. This is a total allowance, not a recurring monthly one, and it does not reset. Once the allowance is used, labels you generate will continue to be produced but will include a watermark, and API access is suspended until you upgrade to a paid plan. Upgrading removes the watermark and restores API access. If a paid subscription later ends, your free tier allowance is reset and prior usage no longer counts against the 1,000 label cap.

Billing: Paid subscriptions are billed monthly or annually in advance. All fees are in US dollars and processed through secure payment processors.

Payment Authorization: By providing payment information, you authorize us to charge your payment method for all applicable fees and taxes.

Failed Payments: If payment fails, we may suspend your account until payment is resolved. Continued non-payment may result in account termination.

Refund Policy: Refunds are not issued automatically. Cancelling a subscription, changing plans, or closing your account does not by itself generate a refund or an account credit. Refunds are generally not provided for used services; however, we will consider requests on a case-by-case basis for the unused portion of an annual subscription due to extenuating circumstances. To request one, contact us at [email protected]. Any refund we approve is issued manually to your original payment method.

Changing Plans: You may change plans at any time. When you upgrade, you are charged the prorated difference for the remainder of your current term and the new plan's features apply immediately. When you downgrade, the lower price takes effect at your next annual renewal — we do not issue account credits or refunds for the remainder of the term you have already paid for.

Founders Rate: Plans purchased at a promotional "Founders Rate" renew at that same discounted price for as long as your subscription remains continuously active. If you cancel and later re-subscribe, or allow the subscription to lapse, the Founders Rate no longer applies and the then-current standard price will be charged. The Founders Rate is a limited-time offer and may be withdrawn for new subscribers at any time.

Price Changes: Except where the Founders Rate applies as described above, we may modify subscription prices with 30 days advance notice. Changes will take effect at your next billing cycle.

7. Intellectual Property

Your Content: You retain ownership of content you upload. By using our Service, you grant us a license to process, store, and display your content solely to provide the Service.

Our Rights: BulkPdfLabels owns all rights to the Service, including software, design, trademarks, and proprietary technology. You may not copy, modify, or redistribute our Service without permission.

Copyright Compliance: We respond to valid DMCA takedown notices. If you believe your copyright has been infringed, please contact us with proper documentation.

8. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data You Upload About Others: The files you upload often contain information about your own customers or recipients. You represent that you have the right to provide that information to us and to have it processed as described in these Terms and our Privacy Policy, and that you have given any notices and obtained any consents required by the laws that apply to you. Where your files contain personal data, you are the data controller and we act as your processor: we process that data only on your instructions and for the purpose of providing the Service. Business customers who require a Data Processing Agreement may request one at [email protected].

Access by Our Team: Our team may access the contents of your uploaded files where necessary to operate the Service, to respond to a support request from you, to comply with the law, or to investigate a suspected security issue or violation of these Terms. Such access is restricted to authorized personnel and is recorded in an audit log. See the "Access by Our Team" section of our Privacy Policy for details.

File Retention: Uploaded files and the labels generated from them are automatically deleted at the end of the retention period for your plan — 12 months on paid plans, 30 days on the free plan, and 72 hours for guest sessions. You are responsible for downloading and retaining your own copies of anything you need to keep. We are not liable for the loss of files deleted in accordance with this schedule.

Data Location: Our servers are located in the United States. By using our Service, you consent to your data being processed and stored in the US.

Data Security: We implement industry-standard security measures to protect your data, but cannot guarantee absolute security.

9. Service Limitations and Disclaimers

Service Availability: Our Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or error-free operation.

Technical Limitations: File size limits, format restrictions, and usage quotas may apply based on your subscription level.

Third-Party Services: Our Service may integrate with third-party platforms. We are not responsible for the availability or functionality of external services.

10. Limitation of Liability

To the maximum extent permitted by law, BulkPdfLabels shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold BulkPdfLabels harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you upload or create using our Service

12. Termination

Cancelling Your Subscription: You may cancel at any time, either from the billing page in your account or by contacting [email protected]. Cancelling stops future billing — you will not be charged again at your annual renewal date. Your paid plan remains active for the remainder of the term you have already paid for, and your account moves to the free tier when that term ends.

Closing Your Account: You may close your account at any time from your account settings, or by contacting support. Closing an account with an active subscription cancels that subscription immediately, and you give up any remaining time on the term you have already paid for. Unlike cancelling — which lets your plan run to the end of the paid term — closure moves your account to the free tier straight away, and the unused months are forfeited rather than refunded. If you only want to stop future billing, cancel your subscription instead of closing your account. Termination does not automatically entitle you to a refund for unused portions of a paid subscription; see the Refund Policy above for how to request one.

Termination by Us: We may suspend or terminate your account immediately for violations of these Terms, non-payment, or any other reason at our discretion.

Data Deletion: Upon termination, your account data will be deleted within 30 days unless legally required to retain it longer. Anonymized abuse prevention data (such as device fingerprints and aggregated usage counts) may be retained beyond account deletion to prevent service abuse. This data cannot be used to identify you personally.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States and the State where BulkPdfLabels is incorporated, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved in the federal or state courts located in the United States. You consent to the jurisdiction of these courts.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through email or prominent notice on our Service. Continued use after changes constitutes acceptance of the updated Terms.

For significant changes, we will provide at least 30 days advance notice before the changes take effect.

16. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BulkPdfLabels.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

Assignment: We may assign these Terms to a third party. You may not assign your rights without our written consent.

Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
